A comprehensive guide to the Federal Mogul Asbestos Personal Injury Trust, detailing its purposes, functions, and procedures for claim submission and resolution.
Introduction to Flexitallic Asbestos Trust
Established to address the asbestos personal injury claims arising from exposure to products under the Federal-Mogul Entities' umbrella, the Federal Mogul Asbestos Personal Injury Trust is an institution formed to ensure rightful compensations. Instituted on December 27, 2007, the Trust plays a crucial role in settling claims, keeping the interests of affected parties at the forefront.
Flexitallic Asbestos Trust Purpose and Functions
The primary aim of the Federal Mogul Asbestos Personal Injury Trust is to utilize its assets for disbursing payments towards asbestos-related injury claims. These claims are directly associated with exposures to asbestos-infused products linked to Federal-Mogul and its subsidiaries and divisions.
These companies, including Turner & Newall (T&N), Flexitallic, Ferodo, Federal-Mogul Products Inc. (FMP), Fel-Pro, and Vellumoid, are collectively referred to as the "Federal-Mogul Entities." Each holds a responsibility in accordance with the prevailing tort law and is bound by the Trust Agreement and the Plan of Reorganization.
Flexitallic Asbestos Trust Claim Submission and Resolution
The Trust, with its organization, ensures all legitimate asbestos injury claims against the Federal-Mogul Entities and other connected, protected parties are duly addressed. This is executed per the Trust Distribution Procedures (TDP), sanctioned by the bankruptcy court. The Trust houses four distinct subfunds, each designed for a specific entity.
These subfunds include the T&N, FMP, Fel-Pro, and Vellumoid subfunds, each with its timeline for accepting claims. For instance, the T&N Subfund began its claim acceptance on August 25, 2010, while the FMP Subfund initiated its process on September 17, 2018.
