Kaiser Aluminum Asbestos Trust Fund: Claim Types, Payments and Legal Options

An overview of the Kaiser Asbestos Personal Injury Trust, outlining its purpose, claims submission process, and resolution methods.

Introduction to Kaiser Aluminum Asbestos Trust

Established in 2006, the Kaiser Asbestos Personal Injury Trust is a critical instrument to manage and settle asbestos-related injury claims. This formation resulted from the Kaiser Aluminum & Chemical Corporation Chapter 11 Joint Plan of Reorganization.

Kaiser Aluminum Asbestos Trust Purpose and Functions

Originating from The Kaiser Aluminum & Chemical Corporation's restructuring plan, the Trust's primary mission is to assess, settle, and distribute payments for legitimate asbestos injury claims. The governing rules and criteria for these processes are laid out in the Amended Trust Distribution Procedures (often referred to as the "TDP").

Kaiser Aluminum Asbestos Trust Claim Submission and Resolution

For those looking to submit claims, the Trust has set out a specific claim form to be presented as proof. From December 18, 2006, claims were officially accepted by the Trust. Importantly, any claims submitted between December 18, 2006, and June 18, 2007, were considered as filed on June 18, 2007, the Initial Claim Filing Date. Processing of these claims adheres strictly to the procedures highlighted in Section 5.1(a)(1) of the TDP.
